Astana, November 15, House of the Mazhilis. Today, at a plenary meeting, deputies of the Mazhilis approved in the first reading a bill to introduce a new type of military service - service in the reserve. In addition, a number of laws were adopted in the second reading, which were sent for further consideration to the Senate.
Amendments on issues of service in the reserve passed the first reading in the Mazhilis. They were introduced to the deputies by the Minister of Defense Ruslan Zhaksylykov. The bill is aimed at introducing a new type of military service in Kazakhstan - reserve service, based on the principles of voluntariness and territoriality.
According to the member of the Committee on International Affairs, Defense and Security, Ermurat Bapi, the amendments apply to adult Kazakhstanis . The Ministry of Defense will conclude a 3-year contract with citizens who have passed the selection stages. On its basis, they will undergo monthly short-term training in military units and 30-day training camps by order of the department.
– It is planned to increase the combat readiness of the created units. That is, weapons and military equipment will be assigned to reserve servicemen. This, in turn, will allow military units to increase their combat readiness as soon as possible, – the deputy said.
Reservists will be subject to health requirements and age restrictions will be established: for officers up to 60 years old, for sergeants and soldiers - up to 50 years old. They will serve in military units at their place of residence.
The Mazhilis also ratified the Optional Protocol to the Convention on the Rights of the Child on the communications procedure. The document provides children with the right to international protection of their interests by filing a direct complaint to the UN Committee on the Rights of the Child.
– Children and parents may apply to the Committee provided that they have exhausted all available domestic remedies, including judicial proceedings at the national level. This can be done no later than one year. The Optional Protocol provides for a confidential and closed procedure for reviewing communications, following which recommendations are submitted to the State. It, in turn, undertakes to consider the Committee’s proposals and take the necessary measures, – said Minister of Education Gani Beisembayev.
As Rinat Zaitov, a member of the Committee on Social and Cultural Development, noted in his co-report, our country’s accession to the Protocol will help increase the level of legal protection for children.
Amendments on issues of ensuring national security and service in special government bodies also passed the second reading. According to Konstantin Avershin, a member of the Committee on International Affairs, Defense and Security, the law expands the competencies of the Anti-Terrorism Center of the Republic of Kazakhstan and local executive bodies for coordinating and organizing the prevention of extremism. Social guarantees for employees of special government agencies are also being strengthened. In particular, it provides for voluntary dismissal from national security agencies after more than twenty-five years of service.
Amendments on issues of public associations and social protection of persons employed in work with hazardous working conditions are aimed at ensuring the protection of citizens' rights to freedom of association in accordance with international standards. They provide the opportunity to create a public association by three founders, whereas currently this requires the initiative of a group of citizens of at least 10 people.
In addition, as Nartai Sarsengaliev, a member of the Committee for Social and Cultural Development , said, amendments to the Social Code introduce norms for the introduction of special social payments to persons employed in work with hazardous working conditions.
– This payment will be made to these citizens upon reaching 55 years of age and until retirement age if they have paid mandatory professional pension contributions for a total of at least 7 years and ceased working in jobs with hazardous working conditions. They can independently determine the time of withdrawal of pension savings at the expense of mandatory pension contributions: at 55 years old or at 63 years old, – the deputy informed.
Standards have also been proposed for improving the system of compulsory insurance against accidents during the performance of labor (official) duties, as well as for social support for certain categories of persons injured at work. The law was passed and sent to the Senate.
The law with amendments and additions to the Tax Code and the Law on the implementation of the Tax Code with accompanying amendments on tax issues were also adopted in the second reading.
Member of the Committee on Finance and Budget Murat Ergeshbaev said that as income will not be considered the income of individuals when writing off debts by collection agencies and microfinance organizations, material benefit from savings on the cost of goods and services in their acquisition at the expense of the amount accrued for previously made purchases or services received, as well as targeted savings of children sent from the National Fund, and others.
In addition, a state duty is established at a rate of zero for citizens’ appeals to the Constitutional Court of the Republic of Kazakhstan. Declaration of individuals and reporting for private businesses are also simplified. Other standards are also being introduced, the main ones are planned to come into force on January 1, 2024.
Also, in the second reading, amendments to the Code «On Subsoil and Subsoil Use» were adopted on issues of improving the sphere of subsoil use. They involve optimizing procedures for conducting state expertise, reducing financial and administrative costs for subsoil users in the process of field development.
– The exploration period can be extended at a time to another 3 years with the obligation to make additional investments and reduce the production period. In order to quickly transition to «field» geological work, the approval period in «offices» has been reduced from 6 to 2 months, said the Chairman of the Committee on Ecology and Natural Resources Management Edil Zhanbyrshin.
The amendments are also aimed at the practical implementation of the provisions of Article 6 of the Constitution of the Republic of Kazakhstan regarding the exercise by the state, on behalf of the people of Kazakhstan, of the right of ownership of subsoil. All new large oil and gas fields will be developed with a mandatory participation share of the national company of 50 percent or more.
Today also specialized committees of the Mazhilis adopted two new draft laws: on the ratification of the Protocol on Amendments to the Agreement on Trade Aspects of Intellectual Property Rights, as well as on the preservation and reproduction of the Kazakh breed of sports horses.
At the end of the plenary session, the Mazhilismen sent 18 parliamentary requests to the responsible government bodies on current social and economic issues. All of them are available on the official website and Telegram channel of the Mazhilis.
