The Mazhilis adopted the law "On the production and turnover of organic products" in the second reading


Astana, March 27, House of the Mazhilis. Today, at the plenary session of the Mazhilis, deputies adopted the law "On the production and turnover of organic products" with accompanying amendments in the second reading. Two protocols have been ratified: on financial assistance in the implementation of joint cooperation projects by the EAEU states and on cooperation in the field of transportation of Russian oil through Kazakhstan to China.

Introducing the law "On the production and turnover of organic products" and related amendments, the head of the working group, Aidarbek Khojanazarov, said that they were developed by deputies in order to improve legislation in the field of production and turnover of organic products, as well as its harmonization with international standards and practices of organic production.

The Basic Law provides for the conditions for the transition to the production of organic products, requirements for their production, turnover and labeling. A system of accounting and traceability of organic products and a register of its producers are also being introduced. According to the speaker, these and other changes will allow the certification of organic production for compliance with the requirements of the selected standard, depending on the requests and preferences of the sales market. At the same time, organic products are excluded from certification objects, only the production process itself will be certified.

– Control over the sale of organic products is also being introduced. It will contribute to the protection of consumer rights and public health, the suppression of the turnover of products sold under the guise of "organic", the protection of domestic producers of organic products from unfair competition from importers who mislead our citizens due to false labeling," Aidarbek Khojanazarov said.

The accompanying amendments provide for subsidizing 50% of the cost of the certificate of conformity and subsidizing organic fertilizers. The amendments to the Code of Administrative Offences exclude liability for violation of legislation in the field of organic production in connection with the exclusion of relevant control functions from akimats. At the same time, there will be no activity in the production and turnover of organic products without appropriate control. It will be carried out by conformity assessment bodies, as well as in the field of sanitary and epidemiological welfare of the population.

Following the discussion, the deputies decided to adopt the laws in the second reading and send them to the Senate for consideration.

In addition, the Mazhilis ratified the Protocol on Amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014 in terms of providing financial assistance in the implementation of joint cooperation projects in industries by the EAEU member States. Within its framework, according to Minister of Industry and Construction Kanat Sharlapayev, a new financing format has been developed that will allow enterprises of the member states to implement significant industrial projects and significantly increase mutual investments between the countries, the number of jobs, and increase the sustainability of production complexes.

– The financial assistance mechanism is a pilot, with a period of five years and with the possibility of prolongation. The source of financing is 10% of the total amount of revenues to the budgets of the EAEU countries from special, anti–dumping and countervailing duties. The maximum amount of subsidy for one project is about 1.9 billion tenge per year. The funds are provided by the Eurasian Economic Commission to national financial organizations of the member states and the Eurasian Development Bank in the form of a subsidy in the amount of 100% of the base rate, Kanat Sharlapayev explained.

The deputies also ratified the Protocol with amendments to the intergovernmental Agreement between Kazakhstan and Russia on cooperation in the field of transportation of Russian oil through the territory of Kazakhstan to China.

Energy Minister Almasadam Satkaliyev said that the Protocol provides for updating on transit volumes, tariffs and payment for oil transit. This series also includes the extension of the Agreement for 10 years with the transit of Russian oil in the amount of 10 million tons annually, while the tariff for pumping oil was approved at the level of $ 15 per ton.

– I would like to note the positive aspects of the implementation of this Protocol for our country. First, Kazakhstan gets the opportunity to sell its own oil by replacing Russian oil. Secondly, for the transportation of Russian oil through Kazakhstan, the country will receive 171 million US dollars annually. Over 10 years – USD 1.7 billion. Third, the production facilities of the Pavlodar Oil Refinery are being loaded," said Vera Kim, head of the working group, speaking with a co-report.

In turn, the Committee on Economic Reform and Regional Development has adopted a draft ratification of the Agreement on International Combined Freight Transport between the Governments of the member States of the Organization of Turkic States.

At the end of the plenary session, the Mazhilismen sent 16 deputy requests to the responsible state bodies on topical social and economic topics. All of them are available on the official website and Telegram channel of the Mazhilis.
